NOTICE OF FINDING OF NO SIGNIFICANT IMPACT and NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements
for activities to be undertaken by the City of Bandera
REQUEST FOR RELEASE OF FUNDS
On or about June 13th, 2023, the City of Bandera will submit a request to the Texas Department of Agriculture (Department), Office of Rural Affairs for the release of 2022 Community Development Block Grant funds under Section 104(f) of Title I of the Housing and Community Development Act of 1974 as amended, to undertake a project known as 2022 CDBG City of Bandera Water System Improvement Project #CDV21-0395. The City of Bandera has an aged deteriorating water main along Madrona Lane that results in frequent maintenance issues, water loss, low pressure, and disruptions in service. The existing lines are old, deteriorated, and undersized. The proposed improvements are required to increase pressures for the quality and quantity of water. The city also needs to maintain regulatory compliance with TCEQ, minimize maintenance and operational costs, and provide a desired level of service. Water System Improvements: Install approximately one thousand seven hundred sixty-five linear feet (1,765 l.f.) of water line, fire hydrants, related pavement repair, valves, fittings, and all associated appurtenances, to include administrative services and engineering fees. Funding: CDBG – $350,000; Matching funds from the City’s Utility Fund -$17,500. Total Estimated Project Cost: $367,500. Project Location: Along Madrona Lane from Old Medina Highway to Old Medina Highway; and along Madrona Lane to the dead end, Bandera, Bandera County, TX.
FINDING OF NO SIGNIFICANT IMPACT
The City of Bandera has determined that the project will have no significant impact on the human environment; therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR). The ERR will be made available to the public for review electronically or by U.S. mail. Please submit your request by U.S. mail to the City of Bandera, 511 Main Street, P.O Box 896, Bandera, Bandera County, TX 78003, or by email to specialist@cityofbandera.org.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Bandera. All comments received by 6/12/23 will be considered by the City of Bandera prior to authorizing submission of a request for release of funds. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the City of Bandera at specialist@cityofbandera.org. Comments should specify which Notice they are addressing. Potential objectors should contact the City of Bandera via email to verify the actual last day of the objection period.
ENVIRONMENTAL CERTIFICATION
The City of Bandera certifies to the Texas Department of Agriculture (TDA), Office of Rural Affairs that Rebeca Gibson, in her capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Department’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Bandera to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
The Texas Department of Agriculture will accept objections to its release of funds and the City of Bandera’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request, (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Bandera; (b) the City of Bandera has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Department; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Environmental Review Specialist, Texas Department of Agriculture by email at CDBG_ENVReview@TexasAgriculture.gov. Potential objectors should contact the TDA Environmental Review Specialist at CDBG_ENVReview@TexasAgriculture.gov to verify the actual last day of the objection period.

SOLICITUD DE LIBERACIÓN DE FONDOS
El 13 de julio de 2023 o alrededor de esa fecha, la Ciudad de Bandera presentará una solicitud al Departamento de Agricultura de Texas (Departamento), Oficina de Asuntos Rurales para la liberación de fondos de la Subvención en Bloque para el Desarrollo Comunitario de 2022 en virtud de la Sección 104(f) del Título I de la Ley de Vivienda y Desarrollo Comunitario de 1974, según enmendada, para emprender un proyecto conocido como 2022 CDBG City of Bandera Water System Improvement Project #CDV21-0395. HALLAZGO SIN IMPACTO SIGNIFICATIVO
La Ciudad de Bandera ha determinado que el proyecto no tendrá un impacto significativo en el medio ambiente humano; por lo tanto, no se requiere una Declaración de Impacto Ambiental bajo la Ley Nacional de Política Ambiental de 1969 (NEPA). La información adicional del proyecto está contenida en el Registro de Revisión Ambiental (ERR). El ERR se pondrá a disposición del público para su revisión electrónicamente o por correo de los EE. COMENTARIOS PÚBLICOS
Cualquier individuo, grupo o agencia puede enviar comentarios por escrito sobre la ERR a la Ciudad de Bandera. Todos los comentarios recibidos hasta el 12 de julio de 2023 serán considerados por la Ciudad de Bandera antes de autorizar la presentación de una solicitud de liberación de fondos. CERTIFICACIÓN AMBIENTAL
La Ciudad de Bandera certifica ante el Departamento de Agricultura de Texas (TDA), Oficina de Asuntos Rurales que Rebeca Gibson, en su calidad de Alcaldesa, consiente en aceptar la jurisdicción de los Tribunales Federales si se inicia una acción para hacer cumplir responsabilidades en relación con la proceso de revisión ambiental y que estas responsabilidades han sido satisfechas. La aprobación de la certificación por parte del Departamento cumple con sus responsabilidades conforme a la NEPA y las leyes y autoridades relacionadas, y permite que la Ciudad de Bandera utilice los fondos del Programa.
OBJECIONES A LA LIBERACIÓN DE FONDOS
El Departamento de Agricultura de Texas aceptará objeciones a su liberación de fondos y la certificación de la Ciudad de Bandera por un período de quince días a partir de la fecha de presentación anticipada o de la recepción real de la solicitud (lo que ocurra más tarde) solo si se encuentran en una de las siguientes bases: (a) la certificación no fue ejecutada por el Oficial Certificador de la Ciudad de Bandera; (b) la Ciudad de Bandera ha omitido un paso o no ha tomado una decisión o hallazgo requerido por las regulaciones de HUD en 24 CFR Parte 58; (c) el beneficiario de la subvención u otros participantes en el proceso de desarrollo han comprometido fondos, incurrido en costos o realizado actividades no autorizadas por 24 CFR Parte 58 antes de la aprobación de una liberación de fondos por parte del Departamento; o (d) otra agencia federal que actúa de conformidad con 40 CFR Parte 1504 ha presentado una conclusión por escrito de que el proyecto no es satisfactorio desde el punto de vista de la calidad ambiental.
